Art

01/09/08:

I began to wonder today what would happen if I found some of my work, writing or painting, being used without permission by a large corporation.
Say Big TV Channel decides to use a section of one of my painting is some sort of advertisement. Whether they did it intentionally or not isn’t the point but the fact that it was done. So now a painting that, knowing me, invariably is about defacing pop culture ideas is being used in an ad. You first thought is that I could probably sue and get a load of money. Well you’re not me and you’re probably not an artist. I’ve had this argument with a number of people that given enough money everyone will sell out. I however would not and we can debate that until the opportunity arises. In this theoretical situation Big TV Channel has used my work without permission and defaced it. I don’t want money, no amount of money could replace a dead family member or a memento. Never the less insurance companies and such put prices on these things, dole them out in checks and expect people to move on with their lives. So what if I don’t want the money? As far as I know I’m not legally entitled to anything but money. I can’t make Big TV give me a commercial slot that runs a month with me defacing their company, which is the only equivalency I could imagine.
I hate saying and ones like, It’s better to beg forgiveness than to ask permission, are at the top of the list. “I raped her… but if you give me a moment let me beg forgiveness.” There is no reparation for taking something that doesn’t belong to you or doing something that was not wanted. A thief might be able to return the stolen property but they can never re-instill the sense of security the victim had.
Art in America is treated like an everyday item produced in mass in Taiwan. The art of an artist is not only a product but also the career. Altering or defacing the art would be as detrimental as being a attorney then one day it’s discovered that your college wasn’t accredited and all diplomas are null and void.
Boiled down it comes to what we already know, the justice system is imbalanced and unfair. It that its okay if you still someone’s creative work as long as you have enough money to pay for it later. It is theft, plan and simple and some CEO should sit in a cell it. And don’t think I’m screaming, down with big corporation, the same should go for everyone, including internet idiots doctoring images for their own amusement and posting.

There are so many digital cameras in the word that at some point soon every possible event will be photographed. As of now the pictures people post online aren't as funny as they think. --besides the fact that with easily accessible editing software you can't trust if a photo is real or set up which takes the essence out of it. Some days I wish someone would take my photo so that I could bring up a frivolous lawsuit, not for the money, partially to prove a point about there being too many cameras but mostly I'm tired of having to walk around people with cameras who stop randomly and expect people to not cross the lens as well as blink of the flash when it unexpectedly hits me in a restaurant.

Perhaps tomorrow I will post a top 10 list so that people will think I'm witty and insightful driving more traffic to my webpage/blog.

I'm tired of people using ZOMBIE, NINJAS and PIRATES. They were cool, yes, at one point. Get with the program, it's old and its tired move on.

Blah, blah, blah, legal, legal, legal everything is copyrighted stealing is bad so you shouldn't do it. You can however request permission to use something and you'll more than likely get it, to do that contact the people at middlemuse.com. In fact all questions, comments, and problems with the website should go to them. I however will deal with the true evil doers myself. If you take anything from me and pass it off as your own I will use every legal means to make your life miserable even if you're a homeless child that dances on the sidewalk for money. If I think you ripped something off from me and changed it around just enough so that I can't press charges I will publicly ridicule you for the rest of your life.
